Tahoma;\">其次，当事人所涉罪名的刑法规定同时也对罪名的犯罪对象进行了范围限定，即“前款规定的物品”，而该条第一款规定的“制毒物品”则首先需要满足“违反国家规定”的前提条件；\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">再次，该《刑法》条文中明确说的是“违反国家规定”，这就意味着如仅是违反非国家规定则不构成此罪。而目前与易制毒化学品相关的法规中，只有国务院颁布的《易制毒化学品管理条例》才属于“国家规定”；\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">最后，在《易制毒化学品管理条例》后的附件，易制毒化学品的分类和品种目录中，并没有碘与红磷。即W某所销售的这两类物品并不属于非法买卖制毒物品罪或者制造毒品罪共犯的犯罪对象，不属于需要用刑法予以惩罚的行为。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cstrong>（二）根据C市中级人民法院的判决情况，贩卖红磷与碘并不具备刑法意义上的刑事违法性，也不具备刑事处罚的必要性\u003C\u002Fstrong>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">辩护人在北大法宝官网上进行类案检索，检索到C市中级人民法院关于制造毒品罪的判决书中，内容包含红磷与碘的，一共有14份判决书，其中有一份重复判决，故共13份判决书。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">辩护人对这13份判决书进行分析后发现，虽然在人提供的相关证据中有\u002F被告人提到了有买卖红磷或碘，但最终法院在本院认为部分，全部都是以制造了甲基苯丙胺或者含甲基苯丙胺成分的固体、液体、固液混合物来认定被告人犯制造毒品罪的。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">并且在判断是否主观知情层面，其中有部分案件中出现了购买制毒材料或者目睹制造冰毒的材料所以就应当知情的论述，但这些制毒材料的关键都是有麻黄素或麻黄叶，而并非红磷和碘。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cstrong>（三）在主观上，W某并不知晓自己所贩卖的红磷与碘被买方买去的后续用途\u003C\u002Fstrong>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">第一，W某的文化程度仅为小学，不识字。之前做完笔录在既不认识所记内容，也没请办案民警宣读的情况下就直接签了字，因此笔录中不排除有漏记或者错记的可能性。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">第二，辩护人在会见W某时，W某提到他之前在笔录中承认知道自己卖的红磷与碘是用于制造毒品的供述并非真实。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">第三，W某所处的行业有个不成文的规矩，为了防止最终的买方会跳过中间经销商从而直接在第一手货源人处购买的情形发生，所以在这行内，卖方从不会打听买方买这些材料来做什么、要卖给谁、卖多少。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">第四，买家会和W某都进行电话沟通是因为前几年双方进行正常交易时便形成了如此交易习惯。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">第五，本案W某所卖红磷与碘的价格都位于正常市场价格范围内，最终在减去成本后也只赚150元，不符合真正知晓是拿去制造毒品的卖家从而贩卖的价格区间。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cstrong>（四）本案目前仍处于侦查阶段，不排除后续W某此次所贩卖的红磷与碘最后是被买家用于合法生产、生活，因此W某有不以制毒物品犯罪论处的可能性\u003C\u002Fstrong>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">绝大部分制毒物品具有双重性，既可能被用于制造毒品，同时又在工农业生产和人们的日常生活中发挥着重要作用。因此，对制毒物品犯罪活动的打击，不能影响到正常的生产、生活需要。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">故根据2016年《审理案件解释》第七条第三款之规定，易制毒化学品生产、经营、购买、运输单位或者个人未办理许可证明或者备案证明，生产、销售、购买、运输易制毒化学品，确实用于合法生产、生活需要的，不以制毒物品犯罪论处。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cspan style=\"color: rgb(0, 0, 0); font-family: Tahoma;\">因此关乎到本案罪与非罪的另一个关键事实，即是买方买走W某所贩卖的红磷与碘后，真正拿去做了什么，是否用于了合法生产或者生活需要。此部分事实由于现处侦查阶段，辩护人无法阅卷无法得知案件全貌，故仅能在此提出不排除W某有不以制毒物品犯罪论处的可能性。\u003C\u002Fspan>\u003C\u002Fp>\u003Cp>\u003Cstrong>（五）退一步而言，若贵院坚持认定W某构罪，因其不具备人身危险性，社会危险性，不会妨碍侦查活动的顺利进行，现对其没有羁押的必要性\u003C\u002Fstrong>\u003C\u002Fp>\u003Cp>\u003Cstrong>（六）综合考虑最高法的宽严相济刑事政策，再结合W某的家庭特殊困难状况，本案应当对W某取保候审，从而真正落实中央的具体要求\u003C\u002Fstrong>\u003C\u002Fp>\u003Cp>\u003Cstrong>五、办案结果\u003C\u002Fstrong>\u003C\u002Fp>\u003Cp>\u003Cspan
